Know Your Rights: Navigating ICE Raids and Protecting Your Family

In recent weeks, New Jersey has witnessed alarming ICE raids that have sent shockwaves through immigrant communities. 

One of the most disturbing incidents involved the wrongful detention of a U.S. veteran, a citizen who served this country honorably. Though this individual has since been released, the message is clear: no one is immune to the aggressive enforcement of current immigration policies.

As a nation of immigrants, we must confront this reality and stand together. I, Senator Britnee N. Timberlake, am committed to advocating for humane immigration policies and ensuring our communities have access to the tools and knowledge needed to protect themselves. Knowing your rights is critical now more than ever.

Your Rights Matter Regardless of Immigration Status

Whether you are a U.S. citizen, visa holder, or undocumented immigrant, the U.S. Constitution grants you certain rights. Unfortunately, many people are unaware of these protections, making them vulnerable to unlawful detainment or intimidation. Here are key steps to take if approached by ICE:

  1. Remain Calm and Do Not Run: Running can be used against you legally and may escalate the situation.

  2. You Have the Right to Remain Silent: Inform ICE agents by saying, "I am exercising my right to remain silent."

  3. Request Legal Representation: Do not sign any documents without first speaking to an attorney.

  4. Do Not Open the Door: ICE cannot legally enter your home without a judicial warrant. Ask to see the warrant through the door before taking any action.

These rights exist to protect everyone, but it’s essential to be prepared. Carry proper identification and ensure digital and physical copies of your documents are stored securely. If you have children, make sure trusted family members have access to these records and understand your emergency plan.

What to Do in Different Situations

  • At Home: ICE agents need a warrant signed by a judge to enter your residence. Verify the warrant’s legitimacy before allowing entry.

  • At Work or in Public: You have the right to remain silent and to request an attorney. ICE must adhere to legal procedures, even in public spaces.

  • If Arrested: Contact your attorney immediately. Have a plan in place to notify your family and avoid signing any documents without legal advice.

Create a Family Emergency Plan

It’s important to be proactive by developing a plan that can be activated if someone in your family is detained. Here are steps to consider:

  • Designate a Power of Attorney: Choose someone you trust to manage your affairs and care for your children.

  • Keep Documents Accessible: Store essential documents such as birth certificates, passports, and medical records in a secure location.

  • Memorize Important Numbers: Ensure that key contacts’ phone numbers are committed to memory by all family members.
